Terms of Use - pilotry

This document is a public offer (license agreement) for the use of the pilotry.xyz website (and its subdomains) and the Pilotry application.

1. Acceptance of terms

By using the website or the app, and by making a payment for the PRO plan, you fully and unconditionally accept the terms of this agreement. If you do not agree with any of the terms, please do not use the service and do not make any payments.

2. About Pilotry

Pilotry is a terminal-workspace for working with AI agents. The service is provided to Users for personal or professional use in accordance with the selected plan.

3. Account

Sign-in to the app is done via Google or GitHub (OAuth). You are responsible for the security of your account with that provider. Any actions taken through your account are considered taken by you.

4. Payment Terms and Provision of Non-Exclusive Rights (License)

Use of the basic functions of the service can be done free of charge. Access to the current Pilotry product (PRO plan) is provided on a paid basis. The cost of the PRO plan is 299 Russian Rubles.

Payment for the PRO plan is made on a 100% prepayment basis through the payment provider ЮKassa (LLC NKO "Yoomoney"). This payment is one-time and grants indefinite access to the current Pilotry product while the product is supported. Automated recurring charges (auto-renewing subscriptions) are absent.

Access to the PRO plan features is activated automatically in the User's Personal Account on the website app.pilotry.xyz after the Licensor receives confirmation of a successful payment from the payment system. From the moment of activation of the PRO plan, the Licensor's obligations to provide the right of use (non-exclusive License) are considered fully completed.

Future major versions, cloud services, team features, and additional packages may be sold separately.

5. Refund Policy

In accordance with the legislation of the Russian Federation (including the Law of the Russian Federation "On Protection of Consumer Rights" and the Civil Code of the Russian Federation):

• The User is entitled to cancel the paid PRO plan at any time prior to the actual moment of access provision (activation of the plan in the User's Personal Account). In this case, 100% of the paid amount is refunded to the User.
• Since the non-exclusive right (License) to use the software is provided to the User in full immediately at the moment of activation of the PRO plan in the personal account (provision of access to the features), the Licensor's obligations to provide the License are considered completed from the moment of such activation. After the activation of the PRO plan, no refunds are made for the active license period, except in cases where access cannot be used due to technical issues on the Licensor's side.
• If access to the PRO plan features was not actually provided or does not work properly due to technical issues on the Licensor's side (and this fact is confirmed by diagnostics), the User has the right to request a refund. To request a refund, please send a written request in free form to the email address etilendihlor@gmail.com.
• The refund request will be reviewed within 10 (ten) business days. In case of approval, the refund will be processed using the same payment method that was used to make the purchase.

6. Acceptable use

You agree not to use the service to:

• disrupt the service, bypass its limits, or perform attacks against it;
• reverse-engineer, decompile, or modify the app, except where expressly allowed by law;
• perform unlawful actions or violate the rights of others;
• resell the service or include it in a paid offering to third parties without a separate agreement.

7. Intellectual property

The Pilotry name, logo, website and app design, and the application source code belong to the author of the service. Your code, your files, and your projects remain entirely yours - we do not claim any rights to them.

8. Service "as-is"

The service is provided on an "as-is" basis. We do not guarantee uninterrupted or bug-free operation or fitness for any particular purpose.

9. Limitation of liability

To the extent permitted by the laws of the Russian Federation, the author of the service is not liable for any lost profits, lost data, or indirect or consequential damages arising from the use of, or inability to use, the service.

10. Changes to the service and offer

We may change the terms of this offer, as well as add or discontinue individual features of the service. The current version of the terms is always published on the page pilotry.xyz/terms.

11. Governing law

These terms and any relationship arising from the use of the service are governed by the active legislation of the Russian Federation.
